Welcome to Tatvam Overseas Inc. These Terms and Conditions govern your use of our website and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these terms.

1. General Terms

• These terms apply to all orders placed through our website, email, phone, or in person.
• We reserve the right to modify these terms at any time without prior notice.
• Continued use of our services after changes constitutes acceptance of the new terms.
• All transactions are governed by Indian law and subject to the jurisdiction of Mumbai courts.

2. Product Information & Accuracy

• We strive to provide accurate product descriptions, specifications, and images.
• All dimensions, weights, and chemical compositions are subject to industry-standard tolerances as per ASTM/IS/EN standards.
• Mill Test Certificates (MTC) are provided with every dispatch and govern the material properties.
• In case of discrepancy between website information and MTC, the MTC shall prevail.
• Stock availability is updated regularly but not guaranteed. Please confirm availability before placing orders.

3. Pricing & Payment Terms

• Pricing: All prices are in Indian Rupees (INR) unless specified otherwise.
• Taxes: GST at applicable rates will be added to the invoice.
• Payment Terms:
  • Domestic: 100% advance or credit terms (for approved clients only)
  • Export: LC (Letter of Credit) or TT (Telegraphic Transfer)
• Accepted Payment Methods: RTGS, NEFT, IMPS, Cheque, Bank Transfer, LC
• Orders will be processed only after payment confirmation.

4. Minimum Order Quantity (MOQ)

• Stock Items: Minimum 500 kg per order
• Special/Custom Grades: MOQ varies from 1-3 tons based on mill rolling requirements
• Cutting Services: Minimum charge applies for custom cutting below 100 kg
• We reserve the right to reject orders below minimum quantities.

5. Delivery & Shipping

• Delivery Timeline:
  • Mumbai: Same day / Next day for stock items
  • Maharashtra: 2-3 business days
  • Pan-India: 4-7 business days
  • Export: 15-30 days (depending on destination)
• Shipping Terms: Ex-Works (Mumbai) unless otherwise specified. Freight charges extra.
• Risk Transfer: Risk passes to buyer upon dispatch from our warehouse.
• Delays: We are not liable for delays caused by transportation, customs, or force majeure events.
• Packaging: Material supplied in standard mill packaging. Sea-worthy packing for export orders.

6. Quality Assurance & Documentation

• All material supplied with Mill Test Certificate (MTC) as per EN 10204 3.1 or equivalent.
• Heat number traceability provided on material and documentation.
• Third-Party Inspection (TPI) available on request at buyer's cost.
• Test reports (PMI, Tensile, Impact, Hardness) available on request from NABL approved labs.
• Material conforms to specified ASTM/ASME/EN/IS standards.

7. Returns, Refunds & Cancellation

• Cancellation: Orders can be cancelled within 24 hours of placement if material is not dispatched.
• Returns: Accepted only in case of:
  • Wrong grade/size supplied
  • Manufacturing defect visible upon receipt
  • Damage during transit (must be reported within 24 hours with photo evidence)
• Refund Process: Approved returns will be refunded within 7-10 business days.
• Restocking Fee: 10% restocking fee applies for buyer's convenience returns (if accepted).
• Claims must be lodged within 7 days of receipt with supporting photos/documents.

8. Warranty & Liability

• We warrant that all material conforms to the specifications stated in the MTC.
• No warranty is provided for material performance in specific applications.
• We are not liable for:
  • Consequential damages or loss of profit
  • Improper storage, handling, or fabrication by buyer
  • Corrosion due to improper grade selection
  • Welding defects or fabrication failures
• Maximum liability is limited to the invoice value of the defective material.
• Buyer assumes all risk in application suitability.

9. Intellectual Property

• All content on this website (text, images, logos, designs) is owned by Tatvam Overseas Inc.
• Unauthorized use, reproduction, or distribution is prohibited.
• Product images and specifications may not be used for commercial purposes without permission.

10. Privacy & Data Protection

• Your personal information is collected and used as per our Privacy Policy.
• We do not share customer data with third parties except for order fulfillment.
• Payment information is processed securely and not stored on our servers.

11. Force Majeure

We are not liable for delays or non-performance due to circumstances beyond our reasonable control including but not limited to: natural disasters, war, terrorism, labor strikes, government actions, epidemics, pandemics, mill shutdowns, or transportation disruptions.

12. Governing Law & Dispute Resolution

• These terms are governed by the laws of India.
• All disputes are subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
• Both parties agree to first attempt resolution through good-faith negotiation.
• Arbitration may be invoked as per the Arbitration and Conciliation Act, 1996.
